The Clergy-Penitent Privilege–Questions and a Suggestion

At this point, I assume most of our readers have seen today’s AP story. If not, you can read it here (but be warned: it’s disturbing and disgusting and the church—rightly, imho—comes out looking terrible).

What underlies this miscarriage of justice is the clergy-penitent privilege. And what is that? It’s a legal privilege that protects confessional communications between clergy and a person who goes to the clergy for spiritual counselling.

It’s a state-level privilege, meaning it’s created and governed by state, not federal, law. And in every state it differs at least a little. And honestly, privilege broadly—and clergy-penitent privilege in particular—is outside of my area of expertise. I understand it broadly, but the contours are tough and specific.

Options for Financial Transparency

In today’s Deseret News, Boyd and Chapman then acknowledge:

Of course, it’s fair game to question whether the reserves are adequate or excessive, or whether specific actions with funds are proper, as the Post article and the whistleblower does.  Vast assets require controls and nonprofit reserve investments can be controversial.

On Kirton McConkie’s (Lack of) Women Shareholders

The other night, I was listening to the most recent Slate Money podcast. In its second segment, the hosts talked about the recent gender pay report in the United Kingdom. They specifically mentioned about Goldman Sachs and Condé Nast, both of which, it turns out, have a pretty sizeable gender pay difference.[fn1]

There are undoubtedly many reasons why men’s income was significantly higher than women’s, but the podcast highlighted one in particular: high earners. At Goldman, women make up only 17% of the top quartile by income. At Condé Nast, there are more women at every income quartile, but it appears that incomes are skewed by the top 5%; in fact, the five-person executive committee is entirely men. [Read more…]
